Terms and conditions

In these terms and conditions, the following definitions apply:

1. These terms and conditions apply to every offer made by the trader and to every distance agreement concluded.
2. Before the agreement is concluded, the text of these terms is made available to the consumer. The consumer can store and print the terms.
3. Provisions that deviate, to the consumer's disadvantage, from mandatory consumer law do not apply; the remaining provisions remain in force.

1. If an offer has a limited period of validity or is subject to conditions, this is expressly stated.
2. The offer contains a complete and accurate description of the products. Images are a true representation; minor deviations cannot be grounds for termination or damages.
3. Obvious mistakes or errors in the offer do not bind the trader.
4. The offer applies while stocks last. The trader cannot guarantee product availability at all times; all orders are subject to actual availability. If an ordered product is no longer available, the trader informs the consumer as soon as possible and any amount already paid is refunded.

1. The agreement is concluded at the moment the consumer accepts the offer and satisfies the conditions set for it.
2. The trader confirms receipt of the acceptance by electronic means. As long as receipt has not been confirmed, the consumer may terminate the agreement.
3. The trader takes appropriate technical and organisational measures to secure the electronic transfer of data and ensures a safe web environment.
4. The agreement is concluded in the Dutch language.
5. The trader's privacy statement applies to the processing of personal data under the agreement. It can be consulted on the webshop.
6. [clause 6 under revision]: this clause is under review by our lawyer and is therefore not yet published. At present there is no provision that refuses orders on the grounds of a suspicion of resale.

1. The consumer has a statutory right of withdrawal: they may terminate the agreement within 14 days without giving reasons. This statutory right cannot be restricted.
2. In addition, and on a voluntary basis, the trader offers an extended return period of up to 60 days in total after receipt. For returns from day 15 up to and including day 60, the additional conditions of article 8(6) apply (the product is unused and is returned in its original, undamaged condition and packaging, and the return shipment is insured and at the consumer's expense). This extra period leaves the statutory right of withdrawal under paragraph 1 intact.
3. The reflection period starts on the day after the consumer (or a third party designated by them, not the carrier) receives the product. If multiple products in one order are delivered separately, the period starts on the day the last product is received.
4. If the trader fails to inform the consumer of the statutory right of withdrawal, the reflection period of paragraph 1 is extended to a maximum of 12 months.

1. During the reflection period, the consumer handles the product and its packaging with care. They unpack or use the product only to the extent necessary to establish its nature, characteristics and functioning, as they would be permitted to do in a shop.
2. The consumer is liable for any diminished value of the product resulting from handling that goes beyond what is permitted under paragraph 1.

1. The consumer reports the withdrawal within the reflection period using the model form (annex 1) or in another unambiguous manner, by e-mail to [e-mail address].
2. Within 14 days of this notice, the consumer returns the product, or hands it to the trader.
3. The consumer returns the product as much as possible in its original condition and packaging, in accordance with the trader's instructions.
4. The risk and the burden of proof for correctly and timely exercising the right of withdrawal lie with the consumer.
5. If withdrawal takes place within the statutory 14-day period, the direct costs of returning the product are borne by [the trader: free of charge within 14 days by default / the consumer: to be notified in advance].
6. When using the extended return period (day 15 through 60, article 6(2)), the condition applies that the product is unused and is returned in its original, undamaged condition and packaging, and that the consumer returns it insured and at their own expense. If a return within this period does not meet these conditions, the trader may refuse it or deduct a diminished-value amount.

1. The trader confirms the notice of withdrawal without delay.
2. The trader reimburses all payments made by the consumer, including any delivery costs charged by the trader for the returned product, without delay and within 14 days of the notice of withdrawal.
3. The trader uses the same method of payment as the consumer, unless the consumer agrees to a different method. The refund is free of charge.
4. If the consumer chose a more expensive method of delivery than the cheapest standard delivery, the extra cost of that choice does not need to be reimbursed.
5. The trader may wait to refund until it has received the product, or until the consumer proves that they have returned the product, whichever occurs first.

1. Prices stated are in euros, including VAT and excluding shipping costs, unless stated otherwise. Any shipping costs are shown separately before the order is finalised and are confirmed in the order confirmation.
2. Prices may change, but for agreements already concluded, the price at the time of ordering applies.
3. In the event of an obvious pricing error, the trader is not obliged to deliver the product at the erroneous price. The trader informs the consumer as soon as possible and offers the option to order at the correct price or to cancel the order free of charge.

1. The trader warrants that the products comply with the agreement, with the specifications stated in the offer, and with the reasonable requirements of soundness and usability (statutory conformity, article 7:17 of the Dutch Civil Code).
2. If a defect appears within one year of delivery, it is presumed that the defect was already present at delivery, unless the trader proves otherwise.
3. The trader additionally grants a 3-year commercial warranty against manufacturing and material defects, calculated from the date of delivery. This commercial warranty leaves the consumer's statutory rights intact and does not affect them in any way.
4. No warranty claim exists if a defect results from improper or inappropriate use, use contrary to the manual, self-made modifications or repairs, or from external causes attributable to the consumer: including dropping, impact, exposure to or immersion in water, moisture and power surges. These exclusions leave the consumer's mandatory statutory conformity rights intact.
5. If a return results from a defect not attributable to the consumer (a valid appeal to statutory conformity or the commercial warranty), the trader bears the costs of the return shipment and of repair or replacement. If, after investigation, the defect turns out to be attributable to the consumer (paragraph 4), the return costs are borne by the consumer.

1. REDLAB's products are wellness/care products and not a medical device. No medical claims are made; the product is not intended to diagnose, treat or cure disease.
2. The consumer uses the product in accordance with the supplied manual, including the instructions on eye protection and duration of use.
3. In case of doubt about suitability: for example during pregnancy, in case of photosensitivity, skin or eye conditions, or use of photosensitising medication: the trader recommends consulting a doctor beforehand. Use is at the consumer's own risk.

1. The place of delivery is the address that the consumer has provided to the trader.
2. The trader carries out accepted orders within 30 days at the latest, unless a different delivery period has been agreed. In case of delay, the consumer is notified and may terminate the agreement free of charge.
3. The risk of damage and/or loss of products rests with the trader until the moment of delivery to the consumer.
4. The trader delivers exclusively within the European Union. Orders with a delivery address outside the EU are not accepted; if such an order is nevertheless placed, the trader may cancel it and refund any amount already paid.
5. The consumer is asked to report visible transport damage to the carrier directly upon delivery where possible, and to contact the trader as soon as possible. Failure to make this report leaves the consumer's statutory rights intact, but helps the trader exercise its rights against the carrier or transport insurer.
6. Delivered products remain the property of the trader until the consumer has paid the full amount due.

1. Payment is made via the payment methods offered on the webshop, at the time of ordering, unless otherwise agreed.
2. The consumer reports inaccuracies in the payment details provided to the trader without delay.

1. The trader's total liability for an attributable failure or on any other basis is limited to compensation for direct damage up to a maximum of the amount paid for the relevant agreement.
2. The trader is not liable for indirect damage, including consequential damage, lost revenue or profit, and damage from use contrary to the manual.
3. The limitations and exclusions in this article do not apply if the damage is the result of intent or deliberate recklessness on the part of the trader, in case of death or personal injury, and otherwise not insofar as mandatory law (including the statutory rules on product liability and consumer protection) precludes limitation.

1. The trader is not liable for delay in, or failure to perform, its obligations as a result of circumstances beyond its reasonable control, including adverse weather conditions, traffic or transport disruptions, delays at import, customs or carriers, strikes, disruptions and government measures.
2. In the event of such a circumstance, the trader informs the consumer and the parties agree, if necessary, on an alternative delivery date. If the force majeure lasts unreasonably long, either party may terminate the agreement free of charge, after which the trader refunds any amounts already paid.

1. Complaints about the performance of the agreement must be submitted to the trader fully and clearly described, within a reasonable time after discovery, via [e-mail address].
2. The trader answers complaints within 14 days of receipt. If a complaint requires more time to process, the trader confirms receipt and gives an indication of the timeframe.
3. If the consumer and the trader cannot resolve a dispute together, the consumer may submit the dispute to the competent Dutch court. Independent information and assistance is available from ACM ConsuWijzer (consuwijzer.nl); for cross-border disputes within the EU, the consumer can turn to the European Consumer Centre (ECC-Net).
4. Dutch law exclusively applies to all agreements between the trader and the consumer.

1. By placing an order, the consumer declares to be at least 18 years old, or to be acting with the permission of a legal representative.
2. The consumer does not use the website for unlawful purposes, does not send harmful software, and does not attempt to circumvent or disrupt the website's security, nor to scrape or copy the website in an automated manner.
3. All intellectual property rights in the website and its content: including texts, images, design, logos and the REDLAB brand: rest with the trader or its licensors. Without prior written consent, the consumer may not copy, reproduce or commercially use these.

1. Additional provisions or provisions deviating from these terms must not be to the consumer's disadvantage and are recorded in writing or in a manner accessible to the consumer on a durable medium.
2. If a provision of these terms is void or voidable, the remaining provisions remain fully in force. A provision that comes as close as possible to the purport of the invalid provision then applies in its place.
3. The trader may amend these terms. An agreement already concluded remains at all times governed by the terms that applied at the time of ordering.
4. Failure to enforce, or not immediately enforce, a provision of these terms does not mean that the trader waives the right to do so at a later time.
